Although progress on the bill to introduce further restrictions on tobacco products in South Africa – such as standardised packaging and a total advertisement ban – has been slow, legislative developments are currently taking place as the bill is proceeding in Parliament.
The Tobacco Products Control Act 83 of 1993 defines a tobacco product as a product containing tobacco that is intended for human consumption, and includes, but is not limited to, any device, pipe, water pipe, papers, tubes, filters, portion pouches or similar objects manufactured for use in the consumption of tobacco. Oral tobacco products fall under this definition and are therefore covered by the general tobacco framework. No product-specific laws apply to nicotine pouches.
