Poland brings nicotine pouches under regulation for first time with new law

For the first time in Poland, nicotine pouches are now regulated under new legislation that took effect on 5th July. Bill UD86 has introduced age restrictions and product limitations on nicotine-free e-cigarettes and pouches, marking a significant shift for the emerging sector. The law follows an earlier move on 1st April to raise excise duties on e-cigarettes and disposable products – changes that could particularly strain smaller, law-abiding market players.

The bill, which will apply from 1st August, establishes an excise duty of PLN150 (€35) per kg, which will increase to PLN200 (€47) per kg in 2026 and PLN250 (€59) per kg in 2027.
