In November 2022, a bill intended to regulate the sale, import, advertising, and use of tobacco and vaping and nicotine products was introduced by Katy Ugarte from the left-wing party Peru Libre. The bill aimed to replace the General Law for the Prevention and Control of the Risks of Tobacco Use. The bill was inactive for a while, but almost two years later, in October 2024, it was finally passed. It came into force as law 32159 on 13th November, although some of its provisions won’t be applicable until after the enactment of the law’s implementing regulation.
This report provides detailed analysis of the regulatory framework in place for oral tobacco and nicotine pouches in Peru, covering all policy areas from advertising and labelling restrictions to notification and taxation.
